§ 1. Scope of application

These General Terms and Conditions (GTC) apply to all business relationships between Aurendal GmbH, Musterstraße 1, A-8010 Graz (hereinafter referred to as “Provider”) and its customers in Austria, Germany, and Switzerland who purchase dietary supplements via the Provider’s online shop. The version of the GTC valid at the time of the conclusion of the contract shall apply.

§ 2. Conclusion of contract

  1. The presentation of products in the online shop does not constitute
    a legally binding offer, but rather an invitation to place an order.
    Errors excepted.
  2. By clicking the order button, the customer submits a binding order
for the goods contained in the shopping cart. The seller confirms receipt 
of the order immediately by email. This order confirmation does not
 yet constitute acceptance of the contract.
  3. The contract only comes into effect with the express declaration of
acceptance or the dispatch of the goods by the supplier.

§ 3. Prices and shipping costs

  1. The prices quoted include statutory VAT and exclude shipping costs.
  2. Shipping costs are clearly communicated to the customer during the ordering process and must be borne by the customer.

§ 4. Delivery and delivery conditions

  1. Delivery will be made to the delivery address specified by the customer in Austria, Germany or Switzerland.
  2. Delivery time is usually 3-7 working days, unless otherwise stated.
  3. The supplier is entitled to make partial deliveries, provided this is reasonable for the customer.

§ 5. Payment Terms

  1. Payment can be made either by prepayment, credit card, PayPal or other payment methods offered during the ordering process.
  2. The purchase price is due immediately upon conclusion of the contract.

§ 6. Retention of title

  1. The goods remain the property of the supplier until full payment has been received.

§ 7. Right of withdrawal

  1. Customers who are consumers within the meaning of the Consumer Protection Act have a statutory right of withdrawal.
  2. The cancellation period is 14 days from the day on which the customer or a third party named by him has taken possession of the goods.
  3. To exercise the right of withdrawal, the customer must inform the provider of their decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or email).

§ 8. Warranty and Liability

  1. The statutory warranty rights apply.
  2. The provider is only liable for damages resulting from intent or gross negligence. This does not apply to damages arising from injury to life, body, or health, or from the breach of essential contractual obligations.

§ 9. Data Protection

§ 10. Final Provisions

  1. The law of the Republic of Austria applies, excluding the UN Convention on Contracts for the International Sale of Goods.
  2. The place of jurisdiction for all disputes arising from contractual relationships between the customer and the provider is Graz, provided the customer is a merchant, a legal entity under public law or a special fund under public law.
